It's not a a phrase I've come across, but my dictionary states that 'to vacate' has a special meaning in law; it means 'to annul'.

So, presumably, an offence which is vacated is one that is annulled, or struck from the records.

When a trial date has been set, the trial sometimes has to be postponed for various reasons.

When this happens one of the two sides applies to the magistrates or judge to have the trial "vacated" and set down for another date.
