i have purchased a mobile phone from 'free ads'. this was a private sale, i sent a cheque to the seller, waited for the cheque to clear and the seller to send the phone. days went by and no phone, the seller disputed the fact that i did not receive the phone, checked with the royal mail, and found i was stating the truth. he could not refund my money for a month until he got paid, and then it would be a postal order. this i agreed to. but now, the seller will not answer my e mails, i have left bvoice mails for them, my mobile number, etc but they will not contact me. i have e mailed free ads to explain, and they are niot even responding to my e mails or complaints. i am very frustrated and annoyed with them all; but especially myself. what rights do i have to claim my money back and how given the situation, HELP! sorry question is so long. thanks

For more on marking an answer as the "Best Answer", please visit our FAQ.If someone owes you money, the only thing you can do (which doesn't involve a couple of guys with baseball bats) is to make a formal demand for payment and, if payment is not forthcoming, commence action through the courts.
Send the following letter, using recorded delivery:
"Fred Bloggs
Re: Non-receipt of mobile phone purchased from you, and your subsequent failure to refund monies paid to you.
TAKE NOTICE that I hereby DEMAND IMMEDIATE REPAYMENT of the sum of �XX.XX
Further TAKE NOTICE that if I do not receive payment of this sum within FOURTEEN DAYS, I will commence COURT ACTION against you.
Yours . . . "
