will I be able to go on my honeymoon in july I am going to cancun first but we connect in New york the back to new york for 3 days after 9 in cancun will i be refused entry? I will be travelling from Northern Ireland however i will be travelling on an Irish passport? Could someone please give me some more advice on this I have contacted the embassy and i have been informed I will need a visa I know it could take weeks, I have also contacted various immigration lawyers with regards to this and they have all stated that my crime (now changed to section 47 ABH) is a crime of 'moral turpitude' though I have checked the website and it states that there must be a depraved motive and not an clear intetnt also as the case is being heard in the magistrates the most i can receive is 6 months as I have pleaded it out already, Finally i merely want advice as to should I listen to the immigration lawyers and use there service? (£600 plus VAT) has anyone on here went through the same process for an ABH charge? I know I have to get an ACPO or whatever it is though as I am being sentenced on 23 April it could be two weeks after that before I get that and providing i get an appointment for the embassy sharpish i will be cutting it fine for the cut off point of 10 may when i will have to change my honeymoon at great financial cost to me though i would prefer to change it than 'chance it' go on ahead get stopped and turned away and then banned for life!

The worst your sentence can be is 6 months - YOU said so yourself but somehow half way down it changed to suspended at worst - which is it?

If you have read other sites that tell you without any doubt you will get a visa go for it, but I would lay money on you being disappointed. More to the point why post here as well if you have been told you will get on OK?

What will happen if you apply for a visa, either through a lawyer or yourself, is that the US Embassy will decide whether your crime is moral turpitude or not. Assault isn't always - depends on intent, use of a weapon, whether that weapon is 'deadly' or not.

If it's not moral turpitude, you will be approved a visa at your interview on the spot and sent it in about a week

If they can't decide, they will refer it to Washington - that could take months.

If it is moral turpitude they will almost certainly refuse you a visa. However, they may suggest you let them apply for a 'waiver of ineligibility' for you - again that will get referred to Washington and can take months, though in simple cases it can be less.

Somewhere on the Embassy website will be advice on how long to allow for 'additional administrative processing', which is another way of saying 'getting a waiver of ineligibility approved'. You might also have to allow longer to wait for an appointment for an interview as only certain staff are trained up in these procedure.

The length of your sentence is not really relevant to your chances of a visa.

Again i hate to hark back to this but was Cheryl Cole not convicted of the same crime people? granted i do not have her money and all the rest but she was, fact, as for the statement about the sentencing the worst for ABH is 5 years yes in the crown court and the case is being heard in the magistrates who can at most give a year though as I have admitted guilt that knocks it off first offence again more time off hence my solicitor has stated that AT WORST i am looking at a suspended sentence here it may not even (hopefully) come to that. I have explained this to several lawyers who specialise in this thing and they say I will get a visa in time though as it is too soon I wont get it now so I have to take my lumps and move on. A lady was on here recently and her husband was given a visa and he had a gbh conviction I thought GBH section 20 and ABH are effectively the same? so how can they give him one and not me? Look I know that I done wrong and I have made my mistake in life but people on here seem to think they are all whiter than white, and look down there noses at others I have never lifted my hand since school yard days and I done this once and I will have to live with it yes I have stated this is all hassle and I know there was hassle involved for the victim as a result of his injuries yet I intend to make amends by whatever means possible.

Answer to pink Kittens if you read my post I am asking for people who have went through the same and have they been given/refused a visa that is all, everyone has a story to tell.
Cheryl Cole will have been applying for a visa as a performer - the rules are different. Performers are not treated as potential illegal immigrants as tourists are. After all their fame means that they'll be easy enough to find and kick out if they decide to chance it.
