grandparents rights?

hi all hope you are having a good evening, maybe you can improve mine by helping with a discussion that i may or may not be losing.

Do grandparents have any legal rights to see grandkids?

Although grandparents do not have an automatic right to contact with their grandchildren, the courts have come to recognise that grandparent's are an essential part of a child's life, and it would be very rare that the court would refuse a grandparent contact, unless there is evidence of abuse or violence.

i may well be losing then, I dont see that the ourt would grant access to the child though would they? as in they cant force a parent to allow their child spend time with a grandparent? I would have thought this was down to the parent to decide.

You're most welcome, tweenyb.........it's a shame more good folk have'nt replied on this thread that no more than i do, but I would assume that they cant force the child to spend time with their grandparent/s if the child feels that he/she does'nt want too.

A lot would be to do with the age of the child/children involved and the court would obviously ask to hear what they say, in private probably, so they can make a decision on what is best for them.

I do wish you all the very best, as this is obviously causing you a bit of worry at the moment and there must be a good reason as to why you dont want contact with the grandparent.
If it is a reason that would cause the child potential harm or upset, then the court would use that to make their decision, as i've already mentioned. :0)

Basically, grandparents do not have any legal rights in the UK.
However, where the parents are divorced or separated and grandparents want to see a grandchild and that is being denied then they can apply for a court order which is costly and long winded and often not successful.

Discussions on a proposed bill giving grandparents some rights in certain circumstances have only recently begun.

"Certain circumstances" is the key point here. The court will look out for what is in 'the best interest of the child' and rule on that.

Exactly Yogi. As you say, at present grandparent's just don't have any rights really at the moment!!

Thanks to you all for your answers. we were debating the legalities last night, essentially of 2 not quite pareents yet who are happily married but neither parent wants a particular set of grandparents to ever have access to the yet to be born child.

luckily this isnt me but friends of mine who are panicking after hearing the term grandparents rights

Ultimately tweeny, in the circumstances you talk about, the grandparents haven't any rights. It is up to the parents who t heir children see until the children are of an age where they case choose. Your friends should not have any worries at all.
