who would be a at fault if we had collided?
a coule of weeks ago, i was parked at the side of the road in designated bays that do not block the road at all...just behind me was a bus stop, which is not a bay sort, so the bus blocks the traffic for a moment...
as the bus had only just stopped, the way was clear for me to pull out...i checked my mirrors and there was no car beside the bus....so i pulled out...but as i did a car overtook the bus and flew round into my lane.
we didnt collide but they beeped me...
to my mind, i have right of way here and i cant be expected to know that they are going to overtake the bus...i know they might do, but i cant sit and wait on the offchance ... you could not see a car overtaking from where i was, until its out the other side so itd have made no difference anyway...
surely they should have been aware that there may have been a vehicle in front of the bus and been ready to pause...
they are the ones performing a manouvre and moving into the wrong lane.
but if theyd hit me...who would have been blamed?
i think them...but am i wrong?

Anyway, i don't suppose you need my answer as you have 120+ already, but from the way you describe it, it seems you were both at fault. You moved when you weren't in a position to see if anyone was coming round the bus, and he moved when he wasn't in a position to see if anyone was pulling out in front of the bus. The fact that he beeped dosen't confer any more blame on you, just that he was faster on his horn than you.
i expect the bus driver thpought you were both inconsiderate

Joko- I think there was some blame on the other driver but it seems clear to me that you would have been held as being more than 50% liable for any accident. Let me explain why then tell me if I have misunderstood.
You say you were in the 1st of 2 lanes on your side of the road. A bus stopped behind you so you pulled out into the second lane. How do you know traffic/the offending car was not already in the second lane? Surely the bus was obstructing the view. So you shouldn't have pulled out until you had a clear view.

i haven't read all the other answers as there's too many. But you would be at fault, from the information in your post. You say that you were stopped in a bay at the side of the road and that the bus stopped on the road, behind you. Therefore, on checking your mirrors, you could only have seen the bus not anything overtaking it. Also, you pulled out onto the road without being sure that it was safe to do so. It's quite obvious that a bus blocking the road at a bus stop is going to be overtaken by other vehicles, but not that a car is going to pull out straight in front of it. It wouldn't matter if they'd hit you from behind either - you're the one that pulled out onto the road that they were already travelling on. sorry!

nini - why wouldnt someone pull out into a gap in traffic...? why shouldnt an overtaking motorist performing a blind manouvre expect that might happen?
if this had happened to me...i woudl just have waited for the car infront to move ahead a bit and pulled in behind them...not blindly swerve back into a lane without knowing if its clear or not...

I haven't read right through this thread but seen most of it and I looked at the google map so I see exactly what you mean joko. The parking outside the chemist is set back and the bus stop further up sets the bus in the main lane. The bus you say was stopped and in my opinion you weren't wrong in pulling away from the kerb because there was the stationary bus further back and like I would, assume that nothing would overtake it because of going into the right hand lane or them not knowing if there was anything in front of the bus.
As for a point of law I can't tell you, but I would hope that he would be in the wrong for overtaking the bus because he could not see ahead of it to make sure there was nothing in that lane. IMO he was wrong and you were right....but that's just me....and that's after looking at the streetview.
