My Wifes car, a peugoet 206 has 3 brake lights, 2 on the side and 1 on the tailgate, 1 light on the side isn't working, would she still be pulled over by the police and get a caution, i'm asking this because I was wondering if both her side lights were working and the 1 on the tailgate wasnt would she still get a caution.

Its not so much that you have two working brake lights, more that the main brake lights (the side ones) are both working.  It doesn't matter about the 3rd high level brake light.

And technically she would get more than a  caution; its a fixed penalty, probably 30.(Though she might get off with it)
Hmmm, I agrre that both side brake lights should be working.  The penalty nowadays (I understand) is deferred as long as the fault is fixed within a certain time.  As far as the centre brakw light goes, if it is fitted it should work, its a fail on the MoT and again the plod can demand that you fix it.
