Driving without due care - advice!
5 Answers
I have recieved a letter from the Police stating that I am being accused of driving without due care and attention and failing to stop at at report an accident. On the date stated I remember "cutting somone up" as I was changing lanes on a dual carriageway. This was not intentional and the driver i cut up was obviously annoyed and beeped his horn, however, he did not indicate that he was hurt, stop or signal for me to stop. We both carried on down the road until the next junction, stopping at lights (the man did not get out of his car at anytime) until we went in opposite directions at the next T junction. As far as I am concerned there has not been an "accident". Neither of us stopped and there is no damage to my car. What are my rights and what will the next step be?

They have to give you that notice within 14 days, before they even consider whether there is a case in it, and probably before they have had a chance to interview the complainant. When they do so, it is likely that they will withdraw the notice. It is possible, however, that injury occurred to someone in his car during a manoeuvre to avoid you, or a collision may have occurred with another vehicle. This would be classed as an accident even though you were not involved in any collision. For the moment, I suggest that you make some notes of exactly what happened, speeds, direction of travel, weather etc. Incidentally, if there was an accident, the other driver is required to stop as well as you. You have a defence in that you were not aware that an accident occurred. He does not seem to have that defence.
i bumped into the back of some nutter that broke too quick and he got out of his car and checked for damage and there wasnt as much as a scratch and then he got into his car and drove off. 3 days later i had the police at my door saying id been involved in an accident and that id left the scene of the accident lol i couldnt believe it, it ended up being his word against mine in the end and no further action was taken, good luck!!! and say youre not guilty!!!
