does anybody know if there is a time limit on when you must recieve a fine for no road tax? I was caught driving my car on 10/09/08 and have just recieved my #192 fine through the post on the 10/10/08, i was caught by a van on the side of the road, I admit to driving with no tax as i couldnt afford it at the time due to finacial reasons, i have heard all sorts of stories such as if you dont recieve the fine with in 2/3 weeks it is void but dont know how true this is, thanks in advance

If you don`t declare your car off road ie S.O.R.N when the tax is out they will automatically assume you are still driving it and send you a fine

Sometimes you can get the fine after a week

it was declared sorn when i was caught, i thought by law you must recieve the fine within a certain time period?
If it was declared sorn then you have declared the car off road

I know it`s a pain in the arse having tax due and having to wait til pay day and thinking it`s ok to drive and cover the disc with your windscreen wiper and all that but the bastads will catch up on you as you`ve found out

I don`t know if there are any time limits but they are sh!thot on stuff like this as your car is not insured if the tax is out and they can crush your car if caught driving whilst it`s sorn

Shame DVLA cant take over immigration
Who has fined you - police or DVLA?

Was you stopped at the time?

Is it a fine or tax due?
Question Author
it is from the dvla, the first part of the letter reads as follows,
We have recieved an offence report alleging that at 10:30hours on 10/09/2008 the above vehicle was seen in CHILTON GARDEN WATLINGTON being used/kept whilst unlicensed.
I was not stopped by the police, just drove past one of their vans that sits on the side of the road,
Watlington as in near Kings Lynn?
Question Author
no its in oxfordshire
Ok- the letter from DVLA, does it state fine or is the tax due?
Since this letter was from the DVLA it is not a fine (only courts can impose fines). It seems they are asking for the revenue due as a result of your keeping the vehicle on the road when you had declared it off road.

This is not a summons or a prosecution and no charges have been laid. Therefore the time limits for notifying you of a potential prosecution and for starting that prosecution do not apply.

You would be well advised to pay the sum due. If you do not a prosecution will be launched and if you are convicted the cost will be many times the amount currently asked for.
hang on guys are we missing something here ?
no tax NO INSURANCE if involved in a accident
Amazing
Neither a lack of road tax nor MOT invalidates a motor insurance policy in respect of third party liability. It is often stated that a car with no tax will tend to be uninsured or have no MOT, but that is based on the presumption that the owner/keeper is unlikely to have paid for part of these requirements while simultaneously chosing not to pay for any of the others.
Question Author
I did have mot AND insurance, it was only tax i didnt have
To be honest I think it's a cheek to drive around with no tax.
Others on here may not like paying car tax but the rule is we have to. If there weren't so many dodgers within the system then maybe costs would not be so high for other tax paying road users.
