I was given a parking ticket recently where all the pay and display macines were out of order and there was no way of paying. I have appealed it and it has been turned down but I wish to take it further. The council say that if I wish to appeal it further I have to wait until the notice to owner is served. My problem is that my car is registered to a contract hire company and if the notice to owner is sent to them they will pay it without question and look to recover the cost (Plus a hefty admin fee) from me. Any suggestions?

Is it possible for you give the contract hire company a bit of warning about the notice that is on its way to them? They might just be able to co-operat with you on this.
As you've admitted to being the driver I would expect the notice to go to you.
Frankieola ring the hire company and tell them that you wish to contest it and if you get the cost you won't repay them, put it in writing.

Coobeastie how would the notice go to Frankieola?
The notice is intended to inform the registered keeper that a fine has been issued and requests details of the driver. If the driver has already appealed the notice will go to them rather than the person/company named by the dvla...proved that is the driver has given their address details. To be on the safe side though prewarn the hire company.

if you can prove that all the machines were out of order, by photographic evidence or witness, then you have nothing to worry about. if you can, then do not pay the fine. If they continue to harrass you for the money, then you are entitiled to sue them for harrassment and trying to obtain monies from you ilegally. good luck. Let people know on here how you get on. Mike.
