sensible barristers don't try to deny the obvious. But it wouldn't have played a part in the actual defence she offered in court.

There have been cases of undisclosed HIV being prosecuted, but it is hardly likely to apply for rape victims - most rapists would think it a lie to deter them anyway.
Couldn't apply to rape victims because they don't consent to having intercourse.
