I have no idea how I would react if I were to wake up and hear what I thought was an intruder in my house. Especially if I lived in SA, and not in the North of Scotland where the crime rate is very low.

I haven't seen all of the evidence, statements, interviews or facts. I have no idea if he intended to kill her or not, but a young woman has lost her life and whatever you think of him, his life will never be the same. Nor will her family or friends ever get over this.

A very sad story all round. I hope justice is served, whatever the crime is deemed to be.
complete and utter h0rseshit, he's 100% guilty, if you have a burglar in the Kasi you shout through the door, "come out and I'll shoot you", having already called the old bill(that's a laugh too!) . The entire country is as bent as a 9 bob, he's bunged the right people including the judge. Bent 1000000000% bent. What is happenning to RSA?
To be found guilty of murder there has to be proof he had a full premeditated intention to kill her.

That was not proved.

So it may now be manslaughter.

Plenty of people in this country kill someone but are not charged with murder. Just because you kill someone it is not always murder.
Given the circumstances, and having listened to a lot of the evidence, I don't see how it could possibly have been pre-meditated and Judge Masipa spelled out very clearly today why she dismissed this charge.
Very reasoned decision there TTT, hard to argue with that summing up!

However, getting back to the facts......he's been found not guilty of First Degree and Second Degree murder in a Criminal Court in the Republic of South Africa.
The judge however in all probability feels that as a result of acting 'hastily' and 'negligently'(not to mention recklessly) he does have some culpability, which he'll be sentenced for tomorrow I'd guess.
There were 3 possible verdicts, premedidated is out, as my learned friends above rightly say.But then then there was Murder but not premeditated, plain and simple thats the one. Does anyone seriously swallow all that old pony about thinking there was a burglar? Perlease! Tell you what I have 5million in a Nigerian bank, can you help me get it out of the country! PMSL, he's bunged the judge and everyone else, that's why he's sold 3 houses in the last 6 months.

That doesn't mean he is guilty of murder!
Gulity of murder imo!!! I still cannot get my head around this, why didn't he scream out to Reeva, 'Are you in the toilet', 'Where are you Reeva', 'Ive got a gun outside the toilet Reeva', I'm going to shoot' ......... surely she would've shouted back that she was indeed in the toilet, 'don't worry Oscar, its only me', END OF!! IMO after following the trial and listening to the evidence, they had an argument, she ran and hid in the toilet and the red mist came down on him and he shot her in cold blood, murder in anyones language. All of the crying and acting in the court didn't wash with me and the vast majority of people there and also watching on live TV, the only person he fooled was the judge!

Chilldoubt the first thing everyone in the world except Oscar Pistorius would do is make sure that the noise you heard isn't your girlfriend lying on the bed right next to you which is very easy by simply glancing over/whispering her name or feeling the bed which is if she was and there was no other occupants then maybe it would be in his own interest to shoot at where the noise was coming from. Others may say he just should have locked the bedroom door so he and his girlfriend were safe then either escape out the window or hide under the bed or in the cupboard and phoned the police.

I am in no position to know whether that verdict is reasonable or not, but I know he fired into a room with, at best, no knowledge of who was there, but knowing his action must maim and probably kill whoever it was. And I note he is still awaiting the verdict regarding culpable homicide.

If you shoot someone dead, isnt that murder? If in self defence that would be manslaughter.

Pisto went armed (expecting an armed intruder) saw none but blindly shot at a sound. Why smash door with bat if there is no further noise or movement in the loo IF he expected he trapped an intruder?
That judge must be a complete retard, or perhaps just buyable.
see the other thread for the difference between murder one and c-homicide in South Africa.......murder one has to be unequivocal and the Judge felt there was sufficient doubt. TTT's highly cynical view I would only accept if a not guilty was returned tomorrow and that I very much doubt.
Based upon the historical evidence on him...hes unbalanced, has anger management issues, extremely jealous, likes using his guns.

He had a row, she wanted out and all this came to the front that night...he knew what he was doing and shot and killed her in yet another instance of his already documented issues
you may well be right, baz, and you can add the effect of the steroids that he is/was on......however, it's speculation and it's the proven factual that the judge has to base her decision on - and in that the prosecution failed to make the case. Tough I know, but that's the basis of law in this, particularly in Murder one.

There was a case in Texas involving one of the Revlon descendants who murdered his boyfriend and chopped the body up to throw it in the Houston Ship Channel. The prosecution went for Murder One (death being the penalty) and it was chucked out....the prosecution/police were complacent in their case presentation to say the least and so it should be rejected, after all with an execution on the line. If they had gone for Murder Two (life), a certain amount of circumstantial evidence is permitted (like in this S.African case) and they would have banged him up.

If it is a not guilty verdict tomorrow then may be TTT has a valid point.
