Parking Charge Again...

I know the rules have changed slightly but not quite sure in what way..

The scenario...my cousin traveled to pick up his new car. It was a 7 hour journey due to delays. On the drive back he felt really sleepy behind the wheel so pulled into motorway services. He ended up falling asleep for a few hours.

Today he got a call from the previous owner saying he'd got a parking charge from Paid Parking Company for £100!! Surely that is too steep? What course of action should he take?

Since the Court of Appeal has ruled that a charge of £85 (for an overstay of less than an hour) "is not extravagant or unconscionable", it might be extremely hard to argue that £100 (possibly for a rather longer time) is:

I could kinda understand it if it was a city centre car park but this was a service station in the early hours of the morning.

Motorists are told to pull over if they are feeling tired....so making yourself road safe by sleeping could cost £100. That's mental...

Does seem exploitative but he could have chosen an off road layby with less security or a b&b.

It could be worse.

I read of one case where a mother, with her young children fast asleep in the back of her car, felt sleepy and (in the interests of road safety) pulled into a lay-by to doze for a short while. A police patrol stopped to investigate and, after she'd explained that she felt too tired to drive, ended up being found guilty of being in charge of a motor vehicle while unfit to drive!

That's awful, Chris, what was she suppose to do?

Driving makes me terribly sleepy if I'm on my own and I have to pull in regular on long journeys.

Carry a cold water spray to avoid drowsiness

So hang on - what's happened about these tickets being invoices and you can ignore them - Did the Court of appeal rule on that as well ?

Not difficult to spray while driving for me. You could pull over if necessary. Much safer than dozing off while driving.

Well seeing is they are chasing the previous owner I would at least ignore it until they started chasing me...

Bazile - they are invoices but you 'just bin them' at your own risk now...

They are starting to become enforceable...

Tambo - if I sprayed water in my face I would automatically close my eyes. Not really a good idea on the motorway!
