The crime charged was 'common assault' it is virtually impossible for common assault to be a jail term. Further the offender has mental health problems which have got worse and for which he is now receiving treatment . Putting him in jail would have ended his treatment and made him even more unstable !
No' Idiot judges' involved , common assault is a magistrates court only offence. The magistrate made the only decision possible under the circumstances. Yet AGAIN ! I have to point out that judges and magistrates do not make up their own laws and sentencing policy they must stick with the guidelines.

I can't agree - an occasional voice of sanity on here, pointing out calmly and rationally how the world actually works, is a real relief from the constant hysteria screaming racism and homophobia that pervades this section on a daily basis.
