If he had taken no alcohol since the night before and that's how he was at 4pm, I shudder to think what he was like the night before. It might explain why he was in custody for ten hours. Most drink drivers who are a small amount over the limit are released fairly quickly - certainly within a couple of hours or so.
goodgoalie - // In the footage on the Daily Mail website, he looks like he has no real idea of where he is. Didn't his mother notice the state he was in? //
He looks like someone who has had a nasty crash, and is in shock, which is what he was. Fortunately, the court will deal with the physical evidence and not try and work out Mr McPartin's state of mind based on a photograph.

kvalidir - // He doesn't look shocked, he looks hammered ( and yes I have personally seen the difference) //
If you can tell the difference between someone who is in shock and someone who is intoxicated (and in this case Mr McPartlin is possibly both simultaneously) merely by looking at a still image, then I suggest you should get a job with the police - they could use a talent like that, since none of them have it.

Andy, it's not a still image, it's a short video; and that is what I based my earlier comment on. I stand by it.
