I’m going for the former.

This is clearly prejudiced behaviour (in that the waiter was prejudging the customers based on their race alone).

But if your takeaway asked you to pay in advance, but not the next customer who is Chinese or Indian, then that would be racism, and that is what happened here.

Took 4 years for this trial to come up. Probably because every fraud with a dodgy case tries to get it heard at the Ontario Human Rights Tribunal.

Perhaps the owners would not care for their customers thinking that they are all to blame for the new ruling?

But the restaurant owners only said that the people running were transients. And homeless people are not all black or all white. So either the owners are lying when they say that have a problem with transients running, or...

However, one possibility will be disallowed a priori from any independent investigation: that this incident may have been contrived by the alleged victim.

I very much doubt they were "facts", AOG. They were racism dressed up as "rationality"; such attitudes should have died when eugenics was thoroughly discredited.

Eugenics is a very plausible theory, Jim: on the whole works well for race horses, doesn't it?

Perhaps you could remind us of its many supporters at the beginning of the last century and their various political colours.

Don't know who discredited it, but do know that the Roman Catholic church was on the wrong side of that slice of history.
