Walking down the road swaying gently in the breeze is not an offence.

I never said they were, strange you did not notice in your rush to have another dig at me, that some of the men and women are not wearing pants.
Walking down the street with your genitals exposed is *not* an offence.
Thrusting your hips about whilst shouting, "What do you think about *this*, missus...?" is an offence....

Yes in this case, both the men and the women have intentionally exposed their genitals.

Both the men and the women in this case obviously intend that people will see them.

As regards to them causing alarm or distress, there are many who would be, alarmed or even distressed at such exposure.

At what age does appearing naked become a "problem"? Fine for babies up to what age? In other countries/cultures being naked is perfectly natural and is not sexualised as in the west. Remember hearing about "outraged" readers commenting on a young woman photographed wearing a bra and knickers - so what about bikinis? The term "indecent exposure" has always puzzled me - what makes it indecent? Sorry, playing devil's advocate here but it's Sunday morning and I'm bored!

Exposure contrary to section 66 of the Sexual Offences Act 2003

This requires a person to intentionally expose their genitals and intend that someone will see them and be caused alarm or distress. It is triable either way. Depending on the age of the defendant and the sentence that is imposed, an offender may be subject to the notification provisions (the sex offender register).

The need to prove that the person exposed their genitals intending that someone will see them and be caused alarm or distress means that a naturist whose intention is limited to going about his or her lawful business naked will not be guilty of this offence.

What is relevant is whether the exposer intended to cause alarm or distress.
