Not unless the two charges had been charged as alternatives to be put before the jury for a decision or they were statutory alternatives (such as careless and dangerous driving).

The point I'm really trying to make is that it would be seen as an abuse of process if prosecutors now charged the three ex-officers with (say) misconduct in public office when they had been acquitted of PCoJ when the allegation is based on the same facts. That simply isn't on but I have an idea that the victims' families would be perfectly happy to see that. In fact it seems from some angles that they would be happy to see anything so long as it results in a conviction of somebody for something.

yeah I was involved in a case where the prosecution/plaintiff didnt disclose documents ( 'this virtually exonerates Dr...)
and later on disclosure - the judge said exactly that - - - " I am so wise, that given the documents I would have determined ezactly the same!"

and how we clutched our bazoomz and cheered - o thank god for that - three cheers for the judges' wisdom and British Justice !
