That would be a little problematic. It would mean that every witness who gave evidence for the losing side in a trial would be open to such a charge. Hardly a way to encourage people to come forward as witnesses. His accusers may have given genuinely truthful evidence but it was insufficient to clear the very high bar of the burden of proof in criminal matters - "beyond reasonable doubt."

perjury under the 1906 act requires a witness to the complained-of act ( not the perjury in court)
