my daughters partner has had his application for compassionate leave to remain on grounds of his and her baby denied.he is told to leave for zimbabwe.what help is he able to get and is an application from zim to come back as a husband and to see his son likely to be granted when or if he goes back to zim? daughter and baby british by birth.

If they are married, got the correct papers and he is the childs father then the chances are verey very good that he will be granted a husbands visa. Was the correct procedure followed for the wedding. was it registered. are there enough photographs and invitations. do they have proof of co habitation or contact before marriage. if yes to all then yes he will get hsubands visa. if not then there is a right of appeal and there is a very good chance that he will be successful. Points to note...has he been illegal or overstayed his visa at any time. If as i suspect the answer is yes then he may have to show good grounds for having done so. nevertheless a pragmatic decision is usually made and husband visa granted.

Hi Rushley, I've been in a similar position myself and actually got married in Zimbabwe three years ago, to my now wife who is Zimbabwean. After the marriage she obtained a 2 year UK spouses visa through the British embassy in Harare and two years later obtained permenant stay. In a years time she can apply for British citizenship.
