I have received notice of intended prosecution for doing 85mph on the m4. The offence is dated in june but the NIP is dated the end of august. The company have past my old address on as i was in one of their vans. Is it worth writting and saying i dont live there anymore? or just take the rap? any help?
So, you're intending on writing to tell them that it can't have been you because you live somewhere else. So, er, how would you know that they were intending to prosecute you, unless someone was forwarding the mail?
You can argue that the NIP wasn't issued within 14 days. They're allowed longer if they can't get your address simply but this is a grey area. A friend of mine replied to a NIP with this argument and was told they were dropping it.
As slimjim says it's a grey area. Don't make things worse by saying you don't live there, just return it with a note explaining what happened. They may well drop it
