I've been given a belt as a birthday present and it's not quite the one I wanted (I'm after a "Jesus Rocks" one and it's a "Jesus Loves You" one).
I took it back to the store - All Saints in Leeds - (unworn and with the tags, etc. still on it) and asked them if the would swap it for the right one and they refused without me having a reciept - which I haven't got as it'a gift and the person who bought it hasn't got it either as they just threw it out once they'd bought the belt.
Is this right by law and consumer rights, etc. etc. blah, blah - all I wanted was a straight swap - i didn't even want a credit note or anything.
The shop assistant who refused said if I could prove it was purchased even with a credit card statement they would swap it but I know that my mate who bought it doesn't own any so will have paid cash, ie. no proof of purchase.
Please help as I really really want the other type of belt.....

And is that something they would have to do even though I haven't got a receipt or proof of purchase.
Also, would they have to replace it like-for-like or could I request the alternative belt that I wanted?
I never even thought to mention the fault when I was in the shop but one of the studs has a small hole next to it as though two holes have been punched for the stud and obviously there's only one stud so there is half of the other hole still showing - like I said, insignificant and not something I'd normally take the belt back for but if it will get me the belt I want them I'm willing to do this.

Well I suppose he's just that type of person (not really the point in question here is it??) just as you're the type of person that DOES keep them - I never keep receipts either - they're just bits of paper that clutter up my house and my wallet or pockets. I never usually need them - in fact this is the first time I've ever needed a receipt!!!
If the belt is genuinelty faulty then you can have a refund but without a reciept would be at the last selling price. The store may offer you an exchange but again only up to the last selling price, so if they are reduced now that is the price you would get. They wiil try to avoid this, but if it was a recent purchase and it is genuinly faulty there isn't anything they can do really, they have to refund u the last selling price in law. Do not threaten to take them to trading standards as you will waste your time, be calm and polite but firm. Also, just to add, most shops can track on their computer any purchase, and they only need to key in the batcode to check for a cash sakle of this item on the date your friend bought it.
