Why can we not staff our system with people who are not so gullible?

Erm.....that's all clear then. Thanks. Still makes no iota of difference to the conclusion me and Tora came to from the evidence in the BBC article which you said wasn't worth commenting on. Evidence which now seems to also have been taken on board by the jury.

The original point was that TTT contended that the High Court was Gullible to quash the conviction. I pointed out that we could never know what evidence was presented to the 'jury less' hearing so we could not judge if the High Court was 'gullible' or not!
I agree this man is evil and is correctly convicted of murder, I also agree that the original conviction for head injuries was correct. What I was arguing was that we can not judge if the High Court was 'gullible' as we can never know what argument or evidence was presented to them, hindsight is wonderful !

the must have been gullible, they incorrectly freed him, they must have been conned. "She walked into a door your honours" - well why didn't you say so, off you go!
^ I agree with you on that, but I can't agree the the High Court were 'gullible' without evidence as to what they heard.
They evidently were in light of the new conviction! This is the crux of Tora's argument.

and yes I havent bothered to find out since this is a 3T thread
but the trial would have been a jury trial
and so the judge is not at fault

and yes one of the rules is that you have to prove the case and not scream loudly and repeatedly - "he is a feral wild animal who is obviously guilty - chop off this head " as the only evidence

and when one person has given perjured evidence
it can be pretty difficult to work out what happened

so really it would be better titled - another belter from 3T

I think we are confusing the first trial and the appeal

Do you not feel that some high court judges are either deliberately gullible or at least naively gullible? If they deliberately gullible we are in deep doodoo. If they are stupid and naïve, who is shipping the fools out?

they are guilty when 12 of their peers say so. Not some clueless dope judges who want to get to their club for a sherry. A you girl is dead because of incompetence, a jury locked the bloke up, he was let out. Can you not get a little angry with a system that allows that? Berate me if you must but look at the picture.
TTT...this case is dreadful. Its quite clear that if his previous conviction had not been overturned, that girl would still be alive. Its shocking.

Cases of child cruelty like this make me very mad ! Every time a new one comes along, I think of poor little Daniel Pelka.
