Phone bought off ebay

A friend of mine bought a phone on ebay and in the description it said the battery were used but when the phone was delivered the battery was missing. Im advising my friend on what to do and the next step ive said is to contact the seller and ask if he had simply forgot to put it in the box, if he says that no battery was included what would the step be ? would it be to ask for a partial refund(obviously depends if the description actually said a battery was included)

Sorry for any confusion, the listing says "COMES WITH BATTERY, "

i think the seller has forgotten to include it

Your friend should contact the seller straight away and ask for the battery, which would have to be posted at the seller's expense if they just forgot to put it in. If you get no joy in a very few days, your friend should open a dispute about the item on the ebay page. If eBay uphold the problem and the seller doesn't resolve it, eBay may be able to refund you but you have to go through that process. A decent seller won't want bad feedback so will sort it out for your friend.
