Iphone Apple Id Problem

Hi.

My husband purchased an IPhone 6 from an online company recently.
He NEVER inserted his sim at any point or went through any set up process. He discovered from Apple that the phone
was made of 3rd party parts. He sent the phone back and got a refund no problem. The company have now contacted him some weeks later to say it's locked into his Apple ID. How is this possible if he didn't insert a sim? He has removed all old phones from his Find my IPhone App (even though we don't think the phone in question appeared there) but the company state the problem still persists. We have sent them a screenshot of the Find my iPhone page to prove its not there. They have said they are going to provide us with evidence from the Apple ID interface.
Can anyone help with this?

If you have an Apple store near you book an appointment (you can do this online) and discuss this with them first. Don't give your Apple ID to the people who supplied your iPhone

Hi I've already done that. But thanks for replying. The seller just can't see that this situation is not possible. Am hoping he gets the message soon!

When you set up the iPhone you would have to have entered your Apple ID to get started and you could do this without inserting a SIM card. When you sell or pass on an iPhone/iPod/iPad etc you need to reset to factory settings and this will remove your Apple ID ready for the next person. If you did not do any set up maybe there was an old Id on there already and that is why you cannot see yours on find my iPhone.
