Black Dot On Camera - Just Appeared, Wont Go Away

Ive only had the phone about 3 weeks but the other day i noticed a black fuzzy circle on all my photos. it is also there just when looking at the screen.
Its not on the handset screen, only on photos or video screen
i did notice when i was using the video, it seemed to wiggle about and move a bit, so i dont think it can be dust?
it seemed to be reacting as i moved the camera about ...
the unit is sealed, and the back does not come off at all so i cant see that grit etc has somehow found its way inside in just 3 weeks.
any ideas - its in quite a prominent place so i cant just ignore it really.
im going to speak to virgin, but just wondered if anyone had had similar and knew what it was, or how to fix it...?
its an Xperia Aqua M, android.

It gets between the elements of the lens, so is out of focus. I'm assuming there's some anti-shake mechanism; the image moves about as you "shake" the camera slightly but the dust doesn't move - the electronics fiddle around to keep the image still, so the dust appears to move when in video mode.
Since you mention Virgin, I assume it's a phone you're talking about. If it claims to be sealed then you have grounds to complain to th supplier.
