What you need to do is seek legal advice to see about what you can do ... you could offer to buy him out for 80k and as you do not have to cover a mortgage on your own it should be viable. If he refuses to move you will have to take legal action to force a sale. You are more likely to win any legal battle I would say, as you have the child to house and care for and he has no income. Whatever happens he cannot just ignore the situation as the stress will not be good for the child and if he really has your child's best interests at heart then he would want to resolve it I would have thought. However after 21 years ... you do not say what the problem is, but is there any hope of mending whatever has gone wrong ??
