Whiskeryron, one big problem with your approach is that many people do not own the car they are driving. You can't seize or destroy a leased car . company car, car share car, rented car, borrowed car or for that matter a stolen car because the person driving it used a mobile phone.
I fully agree with the principle of not using a mobile phone when driving but the answer is to treat it in the same way drink driving is, an immediate 1 year ban from driving for the first offence.
I have been hit head on by a 'school run Mum' who was on the phone to tell them she was going to be late to pick up her child. She drove straight into me on my side of the road!
