If I take my car for an MOT on the 18 Dec but it doesn't officially run out until the 15 Jan and it fails when will it have to be retested by?

Just because you are in possession of an MOT Certificate from almost a year back doesn't mean your car is fit to be used on the road. It was only roadworthy at the time it was tested. Things can go wrong very quickly and it's no defence to say 'I didn't know the car was unsafe to drive when it's got an MOT certificate'.

Incidentally, I have an exhaust pipe on my 14 year old Seat Leon which has been held in place for the past 4years by a twisted welding rod and the car keeps passing its MOT.
