Smashed Windscreen

Hi...I need some guidance. A neighbour asked me if I could help him get an old massive broken TV into his car.I weighed a ton. Anyway as we finally got this giant TV into the back of his car . I attempted to shut the hatch, alas the TV wasn't quite in and subsequently the back windscreen smashed. He doesn't want to claim on his insurance...and we have now gone home. Do you guys think I should pay for another windscreen or maybe pay half?? Or something else ?? Regards

If he has put the matter to his Insurers, I consider it is for them to write to you on the matter of excess.

It could be argued there was negligence or a lack of care by not ensuring the tailgate could close before attempting to do so.

As a result, a claim has been made and an excess is payable, meaning the other person is out of pocket.

If someone contributed to the negligence or lack of care, it could be argued they should pay for or contribute toward any resulting costs.

It could also be argued that the telly would still be in place if another wasn't good enough to lend a hand.

Accidents happen, there's no blame and no claim.

Thanks guys... And he calls himself a Christian.. I've offered half of the excess but still he insists on me paying not only the excess but the total bill and costs.. Spoke to my friend.. He is an ex lawyer who said my offer was generous enough and to do nothing.. He said its laughable.
