I would say that as long as the cooked weight is the same as or close enough to, the one in the photo, that would be okay.
Regarding the size in the image, the average size of the buns could be used to calculate the size of the burger or the size of the seeds could be used to guage it.
No doubt experts on both sides would be used and they could also look at any other images of the bun taken at the original photo shoot to see if they can give more of a clue.

assuming the buns are all the same size (maybe a rash assumption, but these franchises do rely on such standardisation)) it's obvious the publicity photo shows the meat bigger than the bun, while the real-life photos shows it smaller, which matches my own experience. It's more than just the camera angles.
