My 18 year old son recently lent his car to a friend who was not insured and did not have a licence. The car crashed with my son as a passenger. My son received a caution for lending his car to someone he knew had no licence and insurance and has been told he will receive points on his licence and possibly lose it, he has only been driving since last December. His friend has been charged with careless driving, driving with no licence and driving with no insurance. Can anyone tell me what sort of punishment the boys should expect. Thankyou
If your son has received an oficial Police caution he would not usually get points on his licence as well. This would only happen if he had to go to court.
As for his friend, his punishment would depend on his previous convictions and whether he entered a guilty or not guilty plea.
I think he may have become confused between being cautioned for the offence (which is a formal acceptance that he has committed it rather than going to court) and the PACE caution he is given by the officer that he is "not obliged to say anything...." You need to clarify this before investigating options further.
If he has received a caution for the offence, there can be no other punishment levied. There was a case earlier this year where the Police said someone would get a caution and a subsequent private prosecution was ruled out because it would be an abuse of process.
