I left my dads house on bad terms (i took 3000 in cash) and went to new york, i am now back and i want to obtain my hard drive from his house ihe said it will cost �3000 but im already going to court over taking the money can i report this as a theft?

Time to start rebuilding bridges and offering to repay the debt, me thinks, rather than escalating a situation you appear to have created in the first place.
I think your father's reaction was perfectly reasonable in the circumstances.

Are you being prosecuted for theft of the �3K, or is your father claiming it back from you in the civil court? If the latter and if you are still in time to do so you could counterclaim for the value of the hard drive (its true value - which is likely to be insignificant - not an inflated figure) if you want to do that.

yes being prosecuted in criminal court, the hard drive has over 22000 songs purchased from itunes on it so to me its very valuable i have my old credit card bils to prove to a court that they are all mine and not illegaly downloaded, i only took his money as he annoyed me i know its wrong but i just want the hard drive back
joncurtis: doyou know what it takes to make �3000? I seem to think you're living in another world. Did your Dad OWE you the 3 thousand, no. As to making out that your FATHER is a thief I can't imagine a son would do that/ What a horrible world we're living in.....
If you have an ounce of sense or integrity left, you will not even attempt to report your father for theft, especially as he hasn't stolen anything from you!!! Get a grip! You stole �3000 from him. That is a lot of hard earned money he probably needed. The fact that you left your computer incl. HD at his house is not his fault! He is perfectly right, morally to hold on to this until you repay him the money you STOLE from him! You should live without your itunes for a while, pay him back what you owe him and then approach the subject of your HD with him in a conciliatory manner. You've only got one father and it is unbelievable to me that you would consider treating your father in this way after stealing from him! Glad you are not my son!

What a sad world it is when father and son can only sort out their differences through a court. The only people who are going to benefit from your stupidity are the solicitors. If I were your father I would have sold the hard-drive in lieu of the �3000 that you stole from him.

I cant believe you stole from your own father - no matter what went on - and what is worst you dont seem the least bit sorry. I am glad my parents taught me right from wrong as I couldnt imagine being in your situation and neither would I want to.

I agree with buildersmate - its time to make amends and not make things worst.
you shouldnt have taken the money in the first place...now you have probably lost your father and your beloved HD...may this be a lesson learnt!
If I were your father, I would keep the hard drive till �3000 was repaid, then give it you back wiped.

What a statement you make, I only took it because he annoyed me. If I stole from everybody who annoyed me I would be a very rich man. So sad that 22000 tunes is more important to you than your relationship with the old man.

Theft I believe is defined as taking without consent. You left it there, he didn't take it, so it can't be theft.
