My friend had an accident then discovered her MOT had expired 4 months earlier. Insurance have paid out, but police want her to produce documents and only mentioned insurance and driving licence. Are they likely to check if MOT was current and if so are they likely to prosecute. this was an oversight due to changing car and getting muddled with due date

if they do want to see a mot, then you could possibly be charged with fraud by your insurance company or the police, the police would inform your insurance company of no mot, they would then ask for their money back with threat of legal action, they will do anything not to pay out,if they knew at the time they would not have paid you a penny, lets hope they dont need to see it,keep your fingers crossed.

You will most likely get done for the mot, its non endorsable (no points on licence) just a fine. i doubt very much that your insurance will find out so dont worry about a fraud charge.
