How do you know if the fence in the garden belongs legally to you? Where can we find out about the old law about the posts your side means it's your fence? The council were rubbish when we asked them, said the didnt know!

Look at your deeds - if the arrows point in to your garden from the boundary, it's yours.

If the arrows point both ways, it is a party wall. Costs, maintenance and so on should be shared.

The neighbours built a fence with the posts in their land, but the arris rails our side, and its a real eye sore! Can we make them take it down, or change it? All the horrid bits seem to be our side of the fence.

If it's entirely on their land they can do pretty much what they like. It's convention to give your neighbour the good side, but not law.

As ethel says, check the land registry entry - I believe you can do this online for about 2 or 3 quid. A fact that many people don't realise is that generally speaking, even if the fence is yours that doesn't mean you have to maintain it (unless it's dangerous) or even provide it. You could just take it away and tough luck if your neighbours don't like it.

why dont you buy some featheredge boarding from a local fencing company and a couple of kilo of galv nails and make your side nice! leave an inch overlap on each board and then both you and your neighbours can live happily ever after!

You cannot nail anything to his fence without his permission - if it is his fence.

i am not doubting your knowledge.................i just dont believe that is true, if its in your garden you can do anything.
