private road/unadopted road

I live in a very small close where the road is classed as private/unadopted. We are liable for the upkeep of the grass verges and road surface. All residents are sick of the day parkers who are getting free parking but not having to contribute to the upkeep even though they use it as much , if not more than some of the residents. What can we do to make these uncourteous people park somewhere else, get public transport! or can we claim from them a proportion of the upkeep? We need legal advice or proven cures! Many Thanks!!

As all the residents of your road own the road you can charge whatever you want for these intruders to park on your land as long as you have a notice up.

You could print a price list and the date when charges will apply to put on the intruders cars.

Make it expensive, they will soon stop parking there.

or you could employ a car clamping company to monitor the road,but as tourman says,you must have signs up.

if you own it can you not put a sign up warning of clamping and do it if they park there? or do you need a licence to clamp? Charge them then if they dont pay, clamp them and charge �60 unclamping.

First, you need signs to say that the road is private. Then you need signs (may be on the same sign) to warn of clamping. If you employ a car clamping company, their terrorists must be licensed by the Security Industry Authority. The licence is in the form of a badge and must be displayed so that the name and photograph can be seen. The licence costs around �200 for each person, so there are a lot of people doing this unlicensed. For a number of reasons, it is not worth getting involved with unlicensed operators.

Relatives of mine had this problem. They put notices on cars, they tried speaking to the owners all to no avail. Police couldn't help (not public highway), private individuals have no legal powers for issuing fines and in Scotland no clamping etc. Finally towed/dragged offending cars out onto the main road and abandoned them somewhat haphazardly. No car had to have this done more than once :-)

You cant issue a fine as an indivdiual and check before you move any car clamp any car if the car is a doctors car midwife or visitor who needs to be there you dont want to fine them or clamp them and if you do and they take you to the claims court or appeal if could be you paying out
