Deposit returned on Flat - but letting agents want some back!

Hi I moved out of my rented flat, and after inspecting the property the letting agents returned my full deposit, as I had left the flat in immaculate condition. The letting agents called me to say they have since noticed a crack on the ceramic/glass hob, which was a tiny crack (I think it was done when the builders were repairing the kitchen ceiling after it flooded due to a faulty flat roof - but that's another story!), which has grown because of the heat when using the hob. I didn't point out this crack to them, and they did not notice it in the final inspection - I'm guessing the new tenant has told them. Anyway, they now want some of my deposit back (even though the cheque has cleared in my account now), can they do this ?

If they did not notice it at the final inspection then they have no proof that it was there before you left. Admit nothing and tell them that as far as you are concerned the matter is closed. If they threaten to sue you they will need to prove that the damage was done before you left so I think they will have a hard job.

They caught me offguard - I told them the same thing as I posted above - that I thought the builders did it when repairing the ceiling. They said something about talking to the builders to claim from them, but would come back to me - Of course the builders will deny all knowledge or possibly not even remember as it was 18 months ago when they did the work - so they will seek to get the money back from me.
They can ask for whatever they want.

Write a letter (do not speak) and say firmly.

After your inspection the place was given an all clear on the fact it was all in order.

It is apparent that the defect on the hob, or any other defect thus found, is solely down to an unknown party unconnected to me in anyway.

Due to this fact, I shall not part with any of my returned deposit and may I respectfully request this matter is now closed.
