What happens now?
I have just spoken to my sister who told me of her eventful night out last night. They and a small group of others both male and female were at an indian restaurant and had just finished their meals when trouble flared. One particular person in the group was been quite loud but not aggressive in anyway just having a good time, obviously everyone had had a drink but no one was been yobbish in anyway and it all started when a waiter came over and accused this man of speaking inappropriately to his 14 year old son (they had been having a joke about putting porn on the tv on the wall) Immediately the man apologised and said he didn't realise his age and said sorry again but the waiter wouldn't let it go so the man said just f*ck off will you. Then all hell let loose, loads of the staff came swarming out of the kitchen with weapons and all sorts and preceded to beat the hell out of the 2 men. My sister managed to get away but was unable to leave the building as they were all in the way. This attack left the men with quite severe injuries to their head (one was also glassed) and an ambulance and police were called but it was all over when they got there. My sister and a few others gave statements so what will happen next? Will it go to court (4 of the staff were arrested) and what if any will they be charged with abh/gbh or assault? I really hope they don't get away with it because it ruined my sisters night and was totally uncalled for.

I dare say that the staff of the restaurant also had their night ruined, and wouldn't have reacted in the way they did unless they were quited sorely offended at something... It's easy to underestimate how poorly our friends come across to other people who don't know them, when they are drunk. We know their intentions, but others don't.
I did guess that someone would think this but I can assure you and others that they weren't in any way to blame. My sister is 34 and the most sensible person ever!! and she would be the first to say if they were at fault especially as these people involved were not her friends it was the first time she had met them they are her husbands new work colleagues. Even if they were been rude to the staff which they weren't how an earth does that justify having a glass smashed over their heads and been attacked with batons? They were the paying customers after all this wasn't a punch up between 18 year old ******* in the street

I'm sure your sister is a perfectly nice person but she was in a group that was drunk noisy asking for porn to be put on the tv and were probably ruining the evening for all the other customers. It culminates in one of the group telling staff to eff off. They get this sort of behaviour all the time what the staff did was uncalled for but it would be interesting to hear their side of the story
I can understand why you think that but you are so wrong, the 2 people involved were tipsy yes but they were not in anyway aggressive or that drunk they didn't know what they were doing, they made a joke about putting porn on the tv for god's sake and most of the staff were joking and fine with them apart from this one particular personshe along with at least 6 other people have backed her story, the worst off bloke had to have 8 stiches in his head. I can imagine what you are thinking p*ssed kn*bheads causing trouble but this honestly wasn't the case and my question wasn't really asking for your opinions it was asking what if convicted would these thugs get, and yes they are thugs hell if they treat customers that way who the hell wants to eat in their restaurant. It's a case of lets attack the white people and if this was the other way round there would be hell to pay but when a group of indians attack 2 white people you are so judgemental and wrongly presume they are in the wrong. I finish with the injured men are rightfully pressing charges so lets hope the b*stards get locked up for what they did cos it certainly doesn't look good for them right now.
Not condoning what the staff did but I think you are being rather defensive of two people you obviously don't know well. 'Weren't agressive in anyway' Quite normal behaviour is it to go around telling people to f off. I'd like to know what was said in the joke about porn on the tv. Sounds like it might have been quite offensive to upset them that much.
BIG DAD I couldn't agree more! If these judgemental people actually read my question properly all I wanted to know was what convictions if any these men would get I don't think I deserve to be slated for it hell it was nothing to do with me! The men were most definitely not violent to the staff first they are not that sort at all according to my sister and the joke about porn was just that. They said for a laugh can you put some porn on the tv for us you know the sort of thing drunk men do say for a giggle they certainly wern't graphic. Anyway I'm sick of having to defend myself now so unless you have anything constructive and helpful to answer my question in the first place please don't bother.
I'm sorry if you think I'm one of those being judgemental but what I have written above is relevant to your question because these are the sort of questions the defence will raise in order to plead provocation on behalf of the defendants.
The fact is no-one can possibly answer your question because there are too many variables to take into account.
Any previous convictions being one of the obvious ones. The CPS will make the decision on the possible offences when all the evidence has been put together.

Is it ever acceptable to have a 'joke' about tv porn and pictures with someone NOT in your group.
I think if I had made innuendos to a same-sex waiter of a sexual nature, and then found he was 14 I would be more ready to apologise. I dont think f off is ever appropriate......
And if your friend cant recognise 14 yr olds take him out with a paper bag over his head, coz he is gonna get into court again and again.

The owner should not have his 14 year old working in that kind of environment. It must have been late at night. Can't be a responsible parent and a thug to boot. The owner and his staff know what happens in these type of situations - they open late to squeeze in as many people as possible, making a great deal of money. They have to take the good with the bad. All restaurants that are open late and selling booze have to put up with this, its part of the job (and they make a good lving out of it). So what gives them the right to charge in from the back and attack two people with weapons. For god sake - this is Britian not India - mwe are supposed to be living in a civilised society.
