ok me and this guy is doing a DNA test we already know that hes the father when hes name gets added to the birth record can he change the babys last name with out the mothers permission even if the birth record is already done

Hi,

I went through a sticky custody battle with my daughter and her father. The law stated (6 1/2yrs ago) that I being the mother had the sole right of our childs up bringing and he would have visitation rights. Our daugther had his surname and I changed it to mine and I could do this without the fathers concent. I beleive (but I don't know if it stands now) but if you are not married you (woman) has the sole right
