Sadly MIB only has small funding and with ever increasing number of uninsured drivers it cannot afford to pay what the major insurers pay.
Why would America be any different? Who would pay the huge compensation in America. You have to be able to trace the person responsible so you can sue them. And if he has no insurance you could only get as much from him as he can afford- usually nothing!
The real problem is uninsured drivers. We are all subsidising them and they cause misery when they have an accident with us

Yes - and this is what annoys me so much when people on this site say uninsured drivers aren't really a problem because the MIB pays up.
The amount of compensation is severly restricted - if he had been properly insured you would have had proper compensation.
I pay for my own accident / injury insurance - which is what the Americans do. Their compensation culture is funded by the American government.
It makes me so very mad that uninsured drivers are getting away with fines less than the cost of insurance. And I am paying 30 every year because of them,

When someone, through negligence, harms you or your property, you have the right to demand compensation from that person. An insurance policy allows someone to pass the bill on but the absence of insurance doesn't mean that the wrong-doer escapes the liability to pay compensation.
If the uninsured driver has got any form of capital (e.g. a house or a decent car) speak to a solicitor about suing him. (There are plenty of 'no win, no fee' deals around but check the small print before entering into any agreement). You might be able to force the guy to sell his house (for example) in order to provide you with some compensation.
