no my friends rang the police
a bloody long time i hope.. if its gone to crown i would imagine because of the head injury a couple of years at least but thats only a guess talk to a decent solicitor for advise
Question Author
do ineed a solicitor cps are prosecuting.two years? he has no previous just one caution a few weeks ago for same offence on me.
magistrate's can sentence up to 6 months in prison. if they consider (or if the defendant elects for trial by jury - if the allegation is serious enough) that the charges may attract a longer sentence the case goes to Crown.
Question Author
magistrates have decided it should go to crown does that make a difference
is he out on bail, or has he been remanded into custody?
Question Author
police gave him bail with conditions that he does not come near or contact me but when he appeared before magistrates they would not hear the case said it had to go to crown
it means that the magistrates feel it may attract a sentence of over 6 months, so it is considered serious.

each court has Witness Support officers. if you have to give evidence (if he pleads not guilty) you might want to check in with them. if he pleads guilty your statement will be read out in court. the police also have Victim Support who may be able to answer your questions.

don't forget what he did to you. too many women "forgive" (he was drinking, it was the first time, he'll never do it again, he's really sorry, etc..) and find themselves back in the same, or worse, scenario.

take care.. Sara
Do you feel worried about him being on bail? Is he likely to keep his bail conditions?
If you are worried about your safety you should get support from Victim Support. Has this been sorted for you yet, if not get back to the Police for advice.
Have you got any family or friends to help you through this asthe experience must have been terrifying

Stay strong.
He's assauled you twice in three weeks so he has not learnt and would in all likelihood he would do it again . Often these b@stards try and weasle their way back in with lies and promises. I was really relieved you don't intend to have him back.

OMg I sound like Jeremy Kyle . I must go and recover!!!!

i am devastated at a recent sentence passed towards someone who abusedme physically and mentally for 3 years
he was originally in crown court for 2 attempted gbh with intent and putting a person in fear of violence act section 4 with 18 other assualts listed including a threat to put in intensive care .he had previous for common assault on me 3 years ago and was on probation for 18 months and dvp programme which actually made him worse .the charges on him were in realtion to me being 7 months pregnantand kickingand after birth realting to a ceasearen scar
on the day of trial he changed his plea to guitly on abh instead of gbh and last week he was sentenced ..to a 12 month sentence suspendedfor 2 years and 150 hours community service :( no fine no cost no compensation
i had photographic evidenceand medical witnesses and hospital reports
i have since learnt that he actually assaulted his new girlfriend in january and was put on community order then
the law is an ass and everyone who has helped and supported me are gutted at sentence also and while i want to say is i wish i hadnt bothered with all this emotional upset over lasyt year i want to urgeanyone and i mean ANYONE going through domestic violence please dont let them get away with it
i obvioulsy had a ******** judge sentencing that day

sorry to hear he got away with it thats what scares me giving evidence in court and nothing happening him getting away with it and the repurcussions if he just gets a slap on the wrist. i was also mentally abused he used to control me and then started telling me i was fat and ugly and everyone was laughing at me but in the next breath he wouldaccuse me of havuing affairs with everyone. he was in a new relationship after less than 2 weeks with someone 20 years younger than himwho has a small daughter, this woman knows what has happened and that he has to go to court so she goes into it with her eyes open but her 5 year old has no choice about having a drunk violent man around her.
