Box Junctions

I have received a fine for stopping in a box junction. As this was over 2 weeks ago and the amount of miles I drive I cannot remember why I stopped here, however the timings on the penalty charge show 2 seconds. Surely I cannot be billed for 2 seconds? Can I get a copy of the video to see this in real time before the price goes up to �120?

If you decide to go not guilty at court then you/your solicitor would/should have access to he video under disclosure rules.

I think you have fallen foul of a jobsworth in the council camera room who wants to show his boss how good he is!

In theory, yes you've committed the offence. Unlike the police though, council officials have not heard of discretion and just dish out the fines.

unless your way is clear,you must not stop in a box junction,not even for 2 seconds,i know its harsh but if you take it to court,you could end up with a bigger fine and court costs as well.

You an stop if you are turning right and waiting for oncoming traffic to pass before turning.

There is no defence here. you stopped in a yellow box, where you waiting to turn right only prevented by on comming traffic? Was your exit clear? Sorry mate 1 second 10 seconds don't matter the rules are quite clear. It's like getting done for doing 40 in a 30 and then claiming you where only doing 31, still nicked. A bit petty I know but there is no defence, pay the cheap fine and bear it.

Rule number 174
Box junctions. These have criss-cross yellow lines painted on the road (see 'Road markings'). You MUST NOT enter the box until your exit road or lane is clear. However, you may enter the box and wait when you want to turn right, and are only stopped from doing so by oncoming traffic, or by other vehicles waiting to turn right. At signalled roundabouts you MUST NOT enter the box unless you can cross over it completely without stopping.

So, if you were turning right you would be OK otherwise you're knackered and should pay the fine

It's not always that easy though is it?

I have driven a long vehicle in London, and you can guarantee that if you wait outside the box long enough to be sure of getting out of the other side, some bug*er changes lanes to steal your gap. I end up creeping across in the hope that I don't have to stop.

search the pepipoo.com site for similar circumstances. Many yellow box junctions have road markings that are not to the proscribed requirements re road markings and fines are not therefore enforceable. (usually ones for London boroughs). Some moving traffic offences such as this have been decrimminalised and are treated like parking tickets when challenged. Only if you have a FPN issued by the police or CPSO will you have to go to mag court to challenge. The guys on pepipoo have the knowledge to help.
