Assault of an Officer
33 Answers
Hello,
My Brother (19 years) is due in Court this Friday for assulting 2 Police Officers - his story is that they tried to arrest him without reason and so he fought back resulting in hospitalisation. And he is being tried for Credit Card Fraud. Just wondering if anyone would know what sentance he would receive? He has a baby on the way and he just wanted to know how much of his child's life he's going to miss.

I don't believe though, that this particular case alone would have caused the executioner to take his own life. You'd have to have a certain mentality to be able to do this type of job.
I reckon other factors (probably not connected to his work) in the executioner's life would have contributed to his decision to end it.

windywillow, Ellis' account in his autobiography of this particular hanging is very powerful. While it did not directly lead to his suicide, it had a profound and lasting effect on him. For me it redefined the word "terror". What that woman must have suffered during her final days between sentence and execution !

The fact that it has gone to trial tells me that your Brother could not receive a caution for the credit card fraud, The amount is too great, however if he has no previous, then he could be dealt with by conditional caution. The likelihood is though he will receive a conviction and heavy fine for that offence. In relation to the assault Police. Was it recorded as a "Police Assault", though it sounds serious this offence is one of the more minor you could inflict against the Police. If it is recorded as ABH Actual bodily harm s47; or wounding s20 or wounding s18 against the Police, then he is in trouble. The fact that the Police officer attended hospital is a routine procedure to support any "police assault". Any injuries must be recorded. But if the officer was "hospitalised" as a result of this assault, then your Brother is probably looking at a custodial.
