If an estate agent finds you tenants do they have rights over them until they move out of your property? The original one year contract is about to come to an want to take over the management of the tenanacy ourselves. We were informed today by the managing agents that we are 'not allowed' to dispense with their services as they consider the tenants to be 'theirs'. Is that legal????

Agents normally have some such clause in the agreement that you sign. If you signed one, then check the small print. If you didnt, then you are in the clear. You might also be able to "buy off" the agent for an agreed sum.
I had this problem with agents and was threatened with legal action.
1. How many adults live in the house?
2. Did they ALL sign a tenancy agreement with the agent?
3. WHO is on the council taxt, bills etc etc

My tenants were boyfriend and girlfriend. He signed everything. She didn't sign ANYTHING even though they knew she was moving in.

When I wanted to change agents they gave them notice to quit. My new agent (my niece) contacted them and SHE signed all the agreements and HE sign NONE.

They didn't have a leg to stand on.

In this market though unless you are sure then they may chance a couple of threatening letters just to give you a couple of sleepless nights.

Thanks to you both. Actually something very similiar to that is happening. The tenants are staying but increasing their number so, new bloke gets to sign the paperwork! We've given the Agents notice.
