To qualify for Statutory Maternity Pay you need to have been working for your employer for 26 weeks or more by the 15th week before your baby is due.  You must also still be working for your employer during that 15th week & earn 79 or more per week.  You do not have to pay any SMP back, whether you return to work or not.
