I am due for sentencing at the Crown Courts for the ABH and Affray. I have since attended a meeting with The Probation Service for purposes of preparing a Pre Sentencing Report. The officer indicated that a custodial sentence is not what they would recommend however the presence of a weapon(knife) would force recommendation of a custodial sentence.
I conveyed my genuine and sincere remorse for the incident, fully taking responsiblity of my drunken actions despite being provoked and I pleaded guilty at the earliest opportunity. The reason i did this was because i retaliated by using threatening behaviour (with a knife) after i had been attacked with an object and had my property damaged. Within the commotion a third person was accidentally hurt (victim states this in the witness statement) with superficial cuts that required treatment and secondly i do not advocate violent behaviour no matter the circumstances.
I have previously come into contact with the legal system - a caution 2 years ago for battery (drink related incident) and drink driving offences almost 8 years ago.
I have obtained charater references from community persons, my employers and family pleading to the effect that my taking part in the serious incident is out of charater and was due to pure drunkeness.
My legal advisors and representative (barrister) strongly advise me to expect and prepare for a custodial sentence. This obviously causes a great of turmoil to me and my family however i am coming to terms with this as i believe every crime should be punished.
My question is how long should i expect to be incarcerated? It seems my research is failing to provide me answers so i am asking for your thoughts..thank you
