common assult

my partner was arrested for common assult on me he has had his court today but was remanded and sent to pentovile prison which he is going bk to court 2morrow he has had gbh but 6 years ago and hasnt been in trouble with the police ever since apart from a fine he is paying off now what is he likely to get.

As there was only me and him there. The crown prosecution service advised to agree to (I think it was called a passover) anyway it's a civil agreement that he agrees to behaved reasonably. he now has to been reasonable for 1 year. (I've had several harassment things over the last year since the original assault). if he breaks this rule, he will go back to court for the original assault and harassment which I have been told is easier to prove. I have no idea if it was the right decision.
Remember the magistrates have to belief without a shadow of doubt that he is guilty. If he manages to instil any confusion in their minds he gets not guilty.
The other thing I discovered, is the court books hearings for 2 cases knowing they can only hear 1. They put loads of pressure to agree to a civil agreement if I had know about this in advance I would have looked it up.
I guess it all depends on what you are like, and what he is like. Only you can decide.
