I have a mobile ... to dial, I hold it above the steering wheel, so I can see the road ahead ... then I talk ... ILLEGAL.
I have a hands free mobile, clipped on the dashboard on the other side of the car ... to dial, I lean across the car, and look across and down at the dashboard, so I CAN'T see the road ahead ... there could be ANYTHING in the road! ... then I talk ... LEGAL.
So the logic is ...

For more on marking an answer as the "Best Answer", please visit our FAQ.JJ, I think if you are touching the phone to dial out, text, receive data etc then you are breaking the law. My car syncs to the bluetooth via the computer in the car, all my address book comes up there so I can dial out through that, although I usually pull over to do this as it's too much faffing and my eyes would be off the road for too long.
I'm unsure why your mobile is on the other side of the car.
In the unlikely event wanted to dial out whilst driving I'd just need to adjust a knob on the bluetooth receiver to my right, until the name I wanted came up on the display. Granted a distraction so I'm unlikely to do it, but not a massive difference to changing the radio station.
