I am no expert but as i understand it if you have join parental responsibility you are both equally responsible for bringing up your daughter e.g. where she lives, where she is educated etc etc so in theory at least yes your exwife (i am assuming wife here with the presumption being that joint parental repsonibility was set out at divorce proceedings) requires your permission to leave the country with your child as it would need to be a joint decision.

If you are concerned that she would leave without getting your permission it is possible to apply to the court for this issue to be resolved. The court will always consider the welfare of any child to be of paramount importance. One (of four possible steps) the court can take is; Prohibited Steps - an order prohibiting specific steps in relation to a child; for example, a change of surname or removal from the country.

If this was breached it would be a criminal offence (i believe but you need to check)

Don't rush into anything - and try and trust your ex but if you are really concerned maybe you should see a solicitor just to check your legal position (many places do a free first half hour)...

good luck

Firstly does your daughter have a passport she will need her own as no longer can she go on a parent passport as to try and stop this sort of thing, if so try to agree that you or someone else looks after it say a solicitor and you both have to agree to release it.
