It's a common provision in leases and tenancy agreements. Certainly had it in two places I rented. It being specifically mentioned suggests that there has been case law, or simple interpretation, that otherwise it counts as maintenance of the structure and is the landord's responsibility (or liability). So, prima facie, it is.
