Did you father leave a will? In which case things are distributed as per his wishes. If he did not leave one then the laws of intestacy take over. You would need to see a solicitor about his estate in either case.

The info you have given sounds straightforward. You need to apply to the Probate Office for Letters of Aministration, then your fathers esate, after any debts and bills are paid, will be divided equally between his 4 children.

You can object to the CPO but I doubt you'd succeed. I can't imagine you'd finder a buyer- the CPO would be picked up by the buyer or their solicitor.

The administrator of his estate can take the same steps he could have in his lifetime, and the sooner the 4 of you get together and agree on who should be appointed to that post the better.

I hate to burst your bubble, but you are NOT the executor.
You can apply to become administrator (obtain Letters of Admin), but the court would want to know who else has an interst in the estate, and you'd do well to seek consent of all parties first.

i thought that flyhalf, if there is no will there cannot be an executor as none have been named in a will or appointed by the probate registry.
Did the house get the CPO before or after your father died and how far along is the order? The settlement must have involved a solicitor surely and the sum stated in the CPO will be part of the estate for probate as well.

You are right flyhalf. If there is no Will (and presumably no spouse) any one of the children can apply for a grant of Letters of Administration. It is not necessary to notify the other siblings.

It depends on what stage the CPO has reached as to whether the administrator can do anything.

And NO, Michael, you do not have a right to the house. It should be sold and the proceeds split 4 ways.
